We hereby announce that, as detailed below, we received a lawsuit for damages filed against us on June 17, 2011, and that we have decided today to contest the case fully.

2. Party Filing the Lawsuit (hereinafter referred to as "the plaintiffs")

② Location: Suwa District, Nagano Prefecture

3. Details of the Lawsuit
H&P has filed a lawsuit against our company seeking damages, demanding payment of 2,362,287,300 yen as consulting fees and reasonable remuneration under Article 512 of the Commercial Code, based on the consulting agreement concluded with our company on December 20, 2006, plus late payment penalties.

4. Our View
Our company has already paid H&P a total of 300 million yen as monthly commission fees from December 20, 2006 to December 19, 2011, based on a consulting agreement dated December 20, 2006. We believe that the lawsuit filed by the plaintiffs is an unjust claim based on their own arbitrary interpretation. Therefore, our company intends to contest the lawsuit that has been filed in its entirety.
